Законодавство ЄС у сфері промислових зразків: теоретично-практичний коментар (EU Design Law: Theory and Practice)

<b>Ukrainian abstract:</b> Дослідження, що знаходиться перед Вами, покликане ознайомити читачів з теоретичними та практичними аспектами законодавства ЄС у сфері промислових зразків. Аналіз, наведений нижче, – логічне продовження більш теоретичного вивчення нормативно-правового експорту законодавства у сфері інтелектуальної власності, яке здійснює Європейський Союз шляхом укладання двосторонніх торговельних угод. Хоча розповсюдженою є думка, що через укладання таких угод Європейський Союз «нав’язує» своїм партнерам власні стандарти правової охорони та захисту прав інтелектуальної власності (стандарти, що часто не відповідають потребам країни-партнера), у своїх теоретичних розвідках доходимо висновку: проблема скоріше полягає не в нормах законодавства, а в тому, що їх недостатньо розуміють країни-партнери. Дослідження законодавства ЄС у сфері промислових зразків покликане заповнити цю прогалину принаймні в одній сфері регулювання права інтелектуальної власності.<br>Поняття «законодавство» у цьому дослідженні трактуватимемо у широкому сенсі: предметом дослідження стануть не тільки ключові положення Директиви № 98/71/ЄС та Регламенту Ради (ЄС) № 6/2002, а і відповідні правові позиції Суду справедливості ЄС. Такий підхід дозволяє врахувати т.зв. феномен «суддівського активізму», особливо розповсюджений у сфері права інтелектуальної власності, згідно із яким рішення Суду справедливості ЄС часто привносять до норм права тлумачення, які істотно змінюють початково закладений у норми сенс. Теоретично-практичний аналіз також доповнено аналізом національної судової практики держав-членів ЄС та підходів Відомства ЄС з питань інтелектуальної власності, завдяки чому читач зможе глибше зрозуміти окремі аспекти, тлумачення яких викликають протиріччя. Загалом дослідження включає аналіз 10 ключових положень Директиви і Регламенту та 130 рішень відомств та органів судової влади.<br>Сподіваємося, що ця публікація стане у нагоді всім, хто прагне більше дізнатися про законодавство ЄС у сфері права інтелектуальної власності.<br><br><b>English abstract:</b> The research in front of you aims to acquaint readers with the theoretical and practical aspects of EU law in the field of industrial designs. The analysis below is a logical continuation of a more theoretical study on the norm-export of intellectual property acquis by the European Union through the conclusion of bilateral trade agreements. Although it is widely believed that by concluding such agreements, the European Union "imposes" on its partners its own standards of protection and enforcement of intellectual property rights (standards that often may not meet the needs of the partner country), in our theoretical studies we conclude that the issue mostly lies not with the norms themselves, but rather with the lack of their understanding by partner countries. A study of EU industrial design law seeks to fill this gap in at least one area of intellectual property acquis. The concept of "law" in this study will be interpreted in a broad sense: the study will not only cover the key provisions of Directive 98/71/EC and Council Regulation (EC) № 6/2002, but also the relevant case-law of the Court of Justice of the European Union. This approach allows to take into account the so-called phenomenon of "judicial activism", especially common in the field of intellectual property rights, according to which the decisions of the Court of Justice often bring interpretations that significantly change the original meaning of the acquis norms. The Theoretical and practical analysis is also complemented by an analysis of the national case law of the EU Member States and of the approaches of the European Union Intellectual Property Office, which will allow the reader to better understand norms, where contradictions with regards to interpretation exist. In total, this research addresses 10 key provisions of the Directive and of the Regulation, as well as 130 decisions of IP offices and of judicial bodies. We hope that this publication will be useful for all those who want to learn more about EU law in the field of intellectual property rights.
