CONGLOMERATE POWER AND CONTROL OF UNILATERAL CONDUCTS AT CADE

<p><span>This paper seeks to analyze whether the Administrative Council for Economic Defense ("CADE") carries out an analysis of conglomerate power in cases of control of unilateral conduct. In principle, CADE's analysis of conglomerate power is focused exclusively on the control of conglomerate mergers. In view of this, the paper analyzes cases of control of unilateral conduct in order to understand how CADE has analyzed or could have analyzed conglomerate power in these cases. The paper presents an initial explanation of conglomerates in Competition Law, in which the most frequent theories of harm are presented, as well as aspects related to digital ecosystems. The paper then presents a quantitative analysis and a qualitative analysis of 9 (nine) CADE unilateral conduct control cases. This is followed by reflections on the need for CADE to carry out an analysis of conglomerate power in its control of unilateral conduct and, finally, the conclusions are presented.</span></p>
