Preventive Protection of a Well-known Trade Mark under Omani Law – A Comparative Study

Precautionary Protection of Famous Trademarks in Omani Law Omani Law, in particular, and Arabic Law, in general, regulate rules for a trademark in detail. This regulation comes to protect the rights of the owner of that trademark on the one hand and to protect the consumer on the other hand. In this context, famous trademarks are regulated within this regulation, as it is a type of trademark. Since this type of mark extends beyond the borders of the country where it is registered and becomes known in other countries, it becomes significant to protect it in these countries. Protecting it is not only by the rules of civilian liability but also by precautionary rules which prevent other traders in other countries from using this mark. Thus, this study aims to analyze the regulations protecting this mark, particularly in Omani Law and other Arabic laws. The results of this study show that Omani Law sets rules to prevent the registration of famous trademarks in Oman. In addition, Omani Law regulates precautionary procedures that prevent traders from violating famous trademarks. Furthermore, Omani Law sets rules for border measures in this regard. However, Omani Law does not contain a rule preventing the use of famous trademarks. In addition, the border measures in Oman have no effect concerning unregistered trademarks
