Entities administrative proceeding,

The article is devoted to the study of the entities of non‑judicial administrative proceedings
following the reforms associated with the adoption of the Law of Ukraine “On Administrative Procedure.”
The purpose of the article is to clearly outline the composition of entities in administrative proceedings
after the entry into force of the Law of Ukraine “On Administrative Procedure” and to systematize those
entities following the reform, taking into account the author’s proposals for improving and amending the
relevant legislation in the future.
The article examines academic views on the relationship between the concepts “entity of
administrative proceedings” and “participant in administrative proceedings” and traces the genesis of
approaches to the terminological designation of subjects of administrative proceedings.
The article outlines the range of entities of administrative proceedings provided for in the Law of
Ukraine “On Administrative Procedure” and substantiates the need to amend the legislation to eliminate the
practice of designating essentially the same entities by different terms. In particular, it proposes removing the
procedural terms “permit‑issuing authority,” “entity providing administrative services,” and “entity of
application” and replacing them with the unified terms “administrative body” and “applicant.”
The necessity of removing the general term "addressee", which in the Law of Ukraine “On
Administrative Procedure” is used to denote, inter alia, the "applicant" and the "complainant", is
substantiated, alongside the advisability of restricting the term "addressee" to persons in respect of whom
the adoption of an administrative act is initiated by an administrative body within the framework of an
intervention‑type administrative proceedings.
The author conducts a critical analysis of the system of entities in administrative proceedings
enshrined in the Law of Ukraine “On Administrative Procedure” and proposes an original model for its
modification.
