Constitutional Revolution in Mongolia: Is the 1924 Constitution Truly the First Constitution?

Examining the historical development of the Constitution of Mongolia reveals a distinctly unique landscape. Shortly after restoring independence in 1911, concrete steps were undertaken to transition to a constitutional order, establish constitutional institutions, and implement them in practice; however, these efforts were not fully realized due to the societal transitions of the era and the exceedingly complex and critical political circumstances. Nevertheless, this process, in one respect, served as preparatory measures for shifting to a constitutional framework, creating the requisite preconditions, and thereby opening broad opportunities to dismantle the feudal system in the subsequent state era, effectuate a constitutional revolution, and thereafter establish and enforce an uncodified Constitution. In this manner, a constitutional revolution occurred in Mongolia, resulting in the adoption of an uncodified Constitution that operated for a brief yet defined period before yielding to a written Constitution. This sequence can be analyzed and substantiated within the bounds of specific evidentiary materials. Accordingly, this article addresses a historical overview of the evolution of Mongolia’s Constitution and endeavors to elucidate the establishment and implementation of the uncodified Constitution, grounded in particular legal documents. A profound conceptual distinction exists between merely possessing a document titled a “Constitution” and genuinely operating under a Constitution. Thus, this work undertakes an analysis of the uncodified Constitution and its delineated content, offering an interpretation from the standpoint of the Constitution’s essential nature and underlying principles. The outcome aims to introduce a novel perspective to prevailing doctrinal views and stimulate scholarly discourse.
Үндсэн хуулийн хувьсгал Монголд: 1924 оны Үндсэн хууль анхны Үндсэн хууль мөн үү?
Монгол Улсын Үндсэн хуулийн хөгжлийн түүхээс харвал ихээхэн өвөрмөц дүр зураг харагддаг. 1911 онд тусгаар тогтнолоо сэргээсний дараахан үндсэн хуульт байгуулалд шилжих, үндсэн хуулийн байгууллыг тогтоох, практикт нэвтрүүлэх бодит алхмыг хийсэн боловч түүнийгээ бүрэн дүүрэн хэрэгжүүлж чадаагүй нь тухайн үеийн нийгмийн шилжилт, улс төрийн нэн ээдрээтэй, эгзэгтэй нөхцөл байдлаас шалтгаалсан хэрэг байлаа. Гэвч энэ нь нэг талаар үндсэн хуульт байгуулалд шилжих бэлтгэл алхам, урьдач нөхцөлийг бүрдүүлж, дараагийн төрийн үед хамжлагат ёсыг халж, үндсэн хуулийн хувьсгал хийх, улмаар нэгдмэл бус Үндсэн хуулийг тогтоон хэрэгжүүлэх өргөн боломжийг нээж өгсөн юм. Ийнхүү Монгол Улсад үндсэн хуулийн хувьсгал хийж, түүний үр дүнд нэгдмэл бус Үндсэн хууль батлагдан, богино боловч тодорхой хугацаанд хэрэгжиж, бичмэл Үндсэн хуульд халаагаа өгсөн билээ. Үүнийг тодорхой баримтуудын хүрээнд анализ хийн нотлох боломжтой. Иймд энэ өгүүлэлд Монголын Үндсэн хуулийн хөгжлийн түүхэн тоймыг хөндөж, нэгдмэл бус Үндсэн хуулийг тогтоон хэрэгжүүлсэн асуудлыг тодорхой эрх зүйн баримтад түшиглэн гаргахыг эрмэлзэв. Үндсэн хууль гэх нэртэй баримт бичигтэй байх, Үндсэн хуультай байх гэдгийн хооронд сэтгэлгээний асар том ялгаа бий. Иймд нэгдмэл бус Үндсэн хууль, түүгээр тодорхойлогдож буй агуулгын хүрээнд шинжилгээ хийж, Үндсэн хуулийн мөн чанар, үзэл санааны үүднээс тайлбарлах оролдлого хийлээ. Үүний үр дүнд өнөөгийн тогтсон үзэл хандлагад нэгэн шинэ санааг танилцуулж, хэлэлцүүлэг өрнүүлэхийг зорив.
