Justice and Empire: Lumumba's Enduring Shadow

This paper examines the decision by a Belgian court to allow criminal proceedings over the 1961 assassination of Patrice Lumumba, arguing that the case represents more than a delayed legal reckoning. It reflects a structural shift in the balance of historical accountability between Europe and Africa, one increasingly shaped by African agency rather than European concession. The paper traces the anatomy of the case-from the 2011 family complaint through the 2023 charges against former diplomat Étienne Davignon-and analyses its limitations: legal accountability is being applied to discrete individual actions while the wider colonial and Cold War system that enabled Lumumba's removal remains beyond the reach of existing legal frameworks. It further examines how the trial intersects with questions of DRC state legitimacy, the diversification of African international partnerships, and the credibility test it poses for European engagement with the continent. The paper concludes that the significance of the Lumumba trial lies not in its legal outcome alone, but in what it reveals about the evolving dynamics of power, justice, and sovereignty more than sixty years after his death.
