<p dir="rtl"><b>תקציר בעברית: </b>המאמר עוסק בהפריה לאחר המוות. סוגיה זו מסעירה את הציבור הישראלי זה שנים רבות, והדברים התעצמו לאחר אירועי שמחת תורה תשפ"ג (ה-7 באוקטובר 2023) ומלחמת "חרבות ברזל" הארוכה. מטבע הדברים, היא מעסיקה רבות גם את עולם דיני המשפחה ואת עולם ההלכה. במפגש שבין אלו עוסק המאמר.במאמר נראה כיצד ערכי היסוד המשתקפים בדיון בהפריה לאחר המוות מהדהדים את הערכים הדתיים-תרבותיים שבפרקטיקת הייבום הקדומה, ומתוכם נבקש להאיר את הפולמוס העכשווי. בד בבד, נבחן את הדיון ההלכתי העכשווי בהיבטים הנוגעים להפריה לאחר המוות. במסגרת זאת נצביע על תופעה מעניינת: אחד הערכים המרכזיים בעולם הההלכה, העומד לא פעם "מאחורי הקלעים" של שיקולי פרשנות ופסיקה, הוא "דְּרָכֶיהָ דַרְכֵי נֹעַם וְכָל נְתִיבֹתֶיהָ שָׁלוֹם". מרשים לראות כיצד לשיקול זה יש משקל נכבד בדיון בהפריה לאחר המוות. ובאופן מפתיע, בסוגיית הפריה לאחר המוות משמש שיקול זה את הפוסקים בצורה קוטבית – כבסיס משותף לעמדות המנוגדות זו לזו בתכלית.</p>
