The Era of Second Review Petition - Curative Petition

The article is on the curative petition. A curative petition concept is introduced by Supreme Court in "Rupa Ashok Hurra vs Ashok Huurra". This Curative Petition is sometime also called second review petition. Supreme Court has introduced this concept in order that there should not be miscarriage of justice and principles of natural justice must be followed even at last stage of appeal. The article talks about use and misuse of this doctrine. Various strict grounds are available for filling the curative petition and its success ratio is negligible.
