Riba in Shariah

The issue of riba remains unresolved within the realm of Fiqh (Islamic jurisprudence). Many Fiqh stances on riba lack a solid foundation and are difficult to defend in the face of modern intellect. It is unlikely that further efforts revolving around the Fiqh alone will produce different results. Therefore, instead of repeatedly attempting to resolve this stalemate through Fiqh, it is necessary to return to the noble source of Shariah for guidance. The aim of this article is to provide an inclusive perspective on riba based solely on references from Shariah. By recognizing the coherence between riba in the Quran and Sunnah and utilizing current knowledge and available evidence, we can eliminate unwarranted types of riba that have emerged from past misunderstandings. This is necessary because there is no evidence in the Quran and Sunnah that refers to such distinctions in riba and which is the root cause of prevailing confusion. While the prohibition of riba is a law, the question of riba pertains to the philosophy, not law. A concise philosophical argument can carry more weight than a lengthy legal document. The author is seeking to provide a clear and coherent understanding of riba within the rational framework of Shariah, utilizing analytical reasoning and conceptual analysis.
