Los derechos humanos en el sistema internacional e interamericano (Human Rights in the International and Inter-American System)

<b>Spanish abstract:</b> Tal como afirma el politólogo estadounidense Charles R. Beitz, los derechos humanos son “la articulación, en la moral pública de la política mundial, de la idea de que cada persona es sujeto de una preocupación personal”. Para este autor, los derechos humanos se han transformado en el lenguaje en el que se expresa la política global: formular reclamos fundados en los derechos humanos se ha vuelto algo usual a nivel internacional, y no existe nadie que considere que tales reclamos carezcan de importancia. Aún cuando últimamente sean también objeto de escepticismo, incluso por parte de Estados democráticos donde tradicionalmente ha funcionado el Estado de derecho.<br>Es, por tanto, imprescindible, que quienes estudian y practican las Relaciones Internacionales, dominen esa lingua franca de los derechos humanos. Idioma que no carece de dificultad, ya que comparte conceptos con otras ciencias. Por eso, la primera parte del capítulo explora tanto conceptos jurídicos sobre obligatoriedad y fuentes del derecho, como así también distintos mecanismos de influencia de la esfera internacional en el comportamiento de los Estados, que se verificarán útiles para la protección de las personas humanas. <br>Luego se estudia el surgimiento y desarrollo del Derecho Internacional de los Derechos Humanos. Es una descripción de la normativa de fondo y de los mecanismos de protección internacional de los derechos humanos. Se señalan también las críticas y los desafíos que este proyecto de los derechos humanos ha suscitado: entre estos se encuentran su supuesto déficit democrático y la alegada ineficacia de tantas normas y organismos internacionales, ante el evidente incumplimiento y graves violaciones de derechos que se siguen produciendo. También se exploran las dificultades que plantea el multiculturalismo, y el temor tanto a una desnaturalización de los derechos humanos como a un excesivo expansionismo de ellos.<br>Finalmente, en una sección sobre los sistemas internacionales de protección de derechos humanos se explican el Sistema universal o de Naciones Unidas y con especial profundidad el Sistema Interamericano de Derechos Humanos (SIDH) —el régimen de protección regional creado en el ámbito de la OEA. En esta subsección se analizan especialmente las relaciones de los Estados americanos con el SIDH, y se concluye con un balance sobre la situación de los derechos humanos en nuestro continente.<br><br><b>English abstract:</b> As American political scientist Charles R. Beitz argues, human rights are "the articulation in the public morality of world politics of the idea that each person is a subject of global concern". For this author, human rights have become the language in which global politics is expressed: making human rights claims has become commonplace at the international level, and there is no one who considers such claims to be unimportant. Even if they have recently become the subject of skepticism, even in democratic states where the Rule of Law has traditionally functioned.<br><br>It is therefore essential that those who study and practice International Relations master the lingua franca of human rights. This language is not without its difficulties, as it shares concepts with other sciences. For this reason, the first part of the chapter explores both legal concepts on the binding nature and sources of law, as well as different mechanisms of influence of the international sphere on the behaviour of states, which will prove useful for the protection of human beings. <br><br>It follows the study of the emergence and development of international human rights law. It is a description of the basic norms and mechanisms of international human rights protection. We also point out the criticisms and challenges that this human rights project has raised: among these are its alleged democratic deficit and the alleged ineffectiveness of so many international norms and bodies, in the face of the evident non-compliance and serious violations of rights that continue to occur. We also explore the difficulties posed by multiculturalism, and the fear of both a denaturalisation of human rights and an excessive expansionism of them.<br><br>Finally, a section on international human rights protection systems explains the universal or United Nations system and, in particular, the Inter-American Human Rights System (IAHRS) - the regional protection regime created within the OAS. This sub-section analyses in particular the relations of the American states with the IAHRS, and concludes with an assessment of the human rights situation in our continent.
