DEFINITION, CHARACTERISTICS AND TYPES OF MILITARY ADMINISTRATIVE OFFENSES

The article gives a complex theoretical and legal analysis of the definition, characteristics and types of military administrative offenses in the context of the current administrative legislation of Ukraine. It substantiates the relevance of studying the issues of administrative liability of military personnel and persons equated to them in conditions of martial law considering the growth in the number of military service personnel and increased requirements for ensuring military discipline and order of law.
It is established that the Code of Ukraine on Administrative Offenses does not contain a legal definition of a military administrative offense, which complicates law enforcement activities, causes ambiguity in the classification of unlawful acts, and contributes to the formation of inconsistent judicial practice. Scientific approaches are analyzed regarding the essence understanding of military administrative offenses, also their conceptual shortcomings have been identified, and directions for the further development of the relevant doctrine have been outlined.
The author proposes his own definition of a military administrative offense as a socially harmful, unlawful, intentional or negligent act committed by a special subject, such as a military person (including a recruit), a person liable for military service, a reservist during training or a civilian member of a volunteer territorial community formation during participation in the preparation and execution of territorial defense tasks, for which administrative liability is provided for by law.
The feasibility is justified regarding the circle expansion of subjects of military administrative offenses, and the specific features of such acts are characterized.
