Theoretical and practical aspects of improving legal structures

The article is devoted to the theoretical and practical aspects of improving legal structures as an important element of the legal system. The concept and classification of legal structures, their role in lawmaking and law enforcement are studied. Special attention is paid to the analysis of problems related to the imperfection of legal structures in the current legislation of Ukraine, in particular their inconsistency, terminological contradictions and the complexity of legal regulation. The international experience of using legal structures in various legal systems is analyzed. The key areas of their improvement are identified, including harmonization with European standards, digitalization of legal norms and the development of unified legal categories. The author analyzes the nature, essence and classification of legal structures, considers their main functions and significance in lawmaking and law enforcement. Particular attention is paid to problems arising from the imperfection of legal structures, such as legal uncertainty, regulatory conflict, contradictions and complexity of interpreting legal norms. The study examines the main methodological approaches to the formation of legal structures, including formal-logical, comparative-legal, system-structural and other methods. Modern trends in improving legal structures are analyzed, in particular their adaptation to digital technologies, international harmonization of legislation and ensuring legal certainty in the context of legal reforms. The practical aspect of the article consists in studying specific examples of successful improvement of legal structures in various branches of law, including civil, administrative, criminal and economic law. Proposals are made to improve legislative techniques and law enforcement practice by improving legal structures, which will contribute to increasing the efficiency of legal regulation and ensuring the stability of the legal system.
